An I-9 form is a required employment document used by U.S. employers to verify the identity and legal work authorization of every new hire. Also known as a “Employment Eligibility Verification form,” this process helps ensure that all employees whether citizens or noncitizens are eligible to work in the United States.

What is an I-9 form?

The I-9 form, officially known as the Employment Eligibility Verification form, is a U.S. Citizenship and Immigration Services (USCIS) document that all employers must complete for each new hire. Its purpose is to verify the identity and employment authorization of individuals hired for employment in the United States.

When is an I-9 form needed?

I-9 form is needed for every new hire on or before their first day of employment to verify their identity and employment authorization.

What is the I-9 form process?

The I-9 form process involves several steps for both the employee and the employer:

  1. Employee completes Section 1: On or before the first day of employment, the employee fills out Section 1 of the I-9 form, providing personal information and attesting to their employment authorization status.

  2. Employee presents documentation: Within three business days of the first day of employment, the employee must present original, unexpired documents from the Lists of Acceptable Documents (contained within the I-9 form) that establish both identity and employment authorization.

  3. Employer completes Section 2: The employer examines the documents presented by the employee to determine if they reasonably appear to be genuine and relate to the person presenting them. The employer then completes Section 2 of the I-9 form, recording information about the documents presented.

  4. Employer retains the form: The employer must retain the completed I-9 form for as long as the individual is employed, and for a specific period after employment ends (either three years after the date of hire or one year after the date employment ends, whichever is later).

  5. Reverification (if applicable): If an employee's employment authorization has an expiration date, the employer may need to re-verify their authorization before the expiration date by completing Section 3 of the I-9 form.
